1. Acceptance of terms
These Terms of Service (the "Terms") constitute a binding agreement between you and Peptide.best, Inc. ("Peptide.best," "we," "us"). By accessing peptide.best, creating an account, placing an order, or otherwise using our services (the "Services"), you agree to be bound by these Terms. If you don't agree, don't use the Services. If you are accepting on behalf of an entity (such as a vendor company), you represent that you have authority to bind that entity.
2. Eligibility
You must be at least 18 years old to use the Services. By using the Services, you represent that you are 18+ and have full legal capacity to enter contracts. Vendors must be legally formed business entities with appropriate licenses for their jurisdiction.
3. Your account
You're responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized access. We may suspend or terminate accounts that violate these Terms.
4. The marketplace
Peptide.best is a marketplace. Vendors list products; buyers purchase them. We screen vendors (see Trust & Safety) and we process payments through escrow, but we are not the seller of record for vendor-listed products. The vendor is the seller. The contract for sale of a vendor-listed product is between the buyer and the vendor, with Peptide.best acting as an intermediary.
Where we list a product as sold "by Peptide.best" (rare), we are the seller of record.
5. Prohibited uses
You will not:
- Use the Services for any unlawful purpose, including violating any FDA, FTC, state pharmacy/compounding, or international regulations applicable to your jurisdiction
- Resell products purchased on the Services without our written consent (except as expressly permitted in vendor terms)
- Submit false, misleading, or fraudulent reviews; impersonate other users; circumvent verified-buyer review enforcement
- Use scrapers, bots, or automation to access the Services except for documented API uses
- Interfere with the security, integrity, or operation of the Services
- Upload viruses, malicious code, or content that infringes third-party rights
- Harass, threaten, or abuse other users, vendors, or our staff
- Use the Services to launder funds or evade sanctions
6. Content & reviews
You retain ownership of content you submit (reviews, photos, comments). You grant Peptide.best a non-exclusive, worldwide, perpetual, royalty-free license to use, display, modify, and distribute that content in connection with the Services. You represent that your content does not violate third-party rights and is accurate to the best of your knowledge.
Reviews must come from verified buyers as described in Trust & Safety. Reviews that violate our content policy (fake, manipulative, abusive, off-topic, etc.) may be removed with a logged reason.
7. Payment, escrow, and refunds
Buyer payments are held in escrow until delivery is confirmed. Funds are released to the vendor after a 24-hour inspection window. Buyers may dispute orders before funds release. Refunds are governed by our Returns Policy (15-day window, eligibility rules).
Vendors are paid commission-net via the payout method on file. The platform default commission is 15%; individual vendors may have a different rate per a separate addendum (see Commission Rates). We reserve the right to withhold payouts for fraud investigation, chargeback reserves, or violations of these Terms.
8. Pricing & product info
Vendors set their own prices. Peptide.best does not guarantee the accuracy of product information beyond what our verification has independently established (identity, purity per the COA, etc.). Prices may change without notice; an order is only binding once placed and confirmed.
9. Shipping & delivery
Shipping is governed by our Shipping Policy. Risk of loss transfers to the buyer upon delivery to the carrier; however, our practical policy is to replace lost or damaged shipments at no charge.
10. Intellectual property
The Services, including the website design, code, logos, and content (other than user submissions and vendor product images), are owned by Peptide.best and protected by copyright, trademark, and other intellectual property laws. You may not copy, distribute, modify, or create derivative works without written permission, except for personal, non-commercial use of the Services as intended.
11. DMCA & copyright
If you believe content on the Services infringes your copyright, send a DMCA notice per our DMCA policy.
12. Vendor terms (incorporated by reference)
If you sell on Peptide.best, the Vendor Agreement applies additionally to these Terms. In conflict, the Vendor Agreement controls for vendor-specific subject matter.
13. Medical disclaimer
Peptide.best is a marketplace, not a medical provider. Nothing on the Services is medical advice. Statements about products have not been evaluated by the FDA. Products are not intended to diagnose, treat, cure, or prevent any disease. Consult a licensed healthcare provider before use. See the full disclaimer.
14. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. PEPTIDE.BEST DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PEPTIDE.BEST AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF $100 OR THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.
16. Indemnification
You will defend, indemnify, and hold harmless Peptide.best from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of (a) your violation of these Terms, (b) your violation of any law or third-party right, (c) content you submit, or (d) your misuse of the Services.
17. Dispute resolution & arbitration
You and Peptide.best agree to resolve disputes through binding individual arbitration administered by JAMS in Travis County, Texas, except small-claims-court matters and equitable relief in court for IP violations. You waive any right to a jury trial or class action. The Federal Arbitration Act governs. You may opt out of arbitration within 30 days of account creation by emailing legal@peptide.best with subject "Arbitration opt-out."
18. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws principles. Subject to the arbitration clause, exclusive venue for any litigation is the state and federal courts of Travis County, Texas.
19. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any violation of these Terms or for any reason. You may terminate your account at any time via Account Settings. Provisions that by their nature should survive termination (intellectual property, indemnification, limitation of liability, dispute resolution) will survive.
20. Modifications
We may update these Terms. Material changes will be announced via email to account holders at least 30 days before they take effect. Continued use after the effective date constitutes acceptance.
21. Miscellaneous
If any provision of these Terms is held unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. You may not assign these Terms; we may assign them to a successor in a merger, acquisition, or sale of assets. These Terms, together with the Privacy Policy, Cookie Policy, Disclaimer, and (where applicable) the Vendor Agreement, are the entire agreement.
